Eligibility for and Obligation of Clients
Our services are available to organizations and individuals who are able to form legally binding contracts under applicable law. By accepting the services, you represent that you are at least 18 years of age or have the legal capacity to contract with our firm on behalf of your organization. Clients will provide accurate, complete, and current information upon which the engagement is based. You agree to fully cooperate with BC3Cba, including but not limited to requesting necessary documents or answering inquiries timely to support effective legal representation or legal advice.
Engagement of Services and Relationship with Client
BC3Cba’s engagement with a client commences upon the execution of a formal, written agreement or engagement letter between the client and BC3Cba which has been mutually agreed to by both parties. Initial consultations, whether face to face, tele-conferences, or through emails and/or other online communications are not intended to and will not create any attorney-client relationship as may be commonly presumed or implied, unless otherwise specifically confirmed in writing. The scope of representation, the fees that will apply, including the terms of payment of those fees, will be clearly articulated in the engagement letter. BC3Cba reserves the right to refuse to engage and/or terminate the engagement in accordance with legal and ethical obligations.
Fees and Client Payment Arrangements
BC3Cba strives to be open and fair in our rate structures. Our rates vary based on the nature and complexity of the legal service rendered and may include costs per hour, fixed fees, or contingent fees, where allowed by law. Clients are provided with a statement of their anticipated costs, expenses, and billing arrangements prior to engagement. Payment is rendered according to the terms in the engagement letter. Balances remaining may result in a suspension or termination of service. Payments may be made by check, electronic transfer, or other means mutually agreed to through our office. If no resolution is possible, disputes will thereafter be settled by mediation or arbitration held in Bakersfield, California. These terms are to be governed by and construed according to the laws of the State of California without regard to its conflict of law principles.
