If you do not agree to these Terms of Service, do not use the Services or access the website. BC3Cba may, at its sole discretion, modify or revise the Terms of Service from time to time. Any changes will be effective upon their initial posting; however, when appropriate we will provide communication of these changes directly to the email address you have provided to BNKC. Requirements for Eligibility; Representations About Clients

BC3Cba provides our services solely to individuals and businesses lawfully able to enter into binding contracts in the relevant law. By engaging our firm you represent that you are at least eighteen (18) years of age or otherwise have legal capacity to enter into contracts in your jurisdiction. Businesses must be duly organized and in good standing under applicable laws of their jurisdictions. BC3Cba reserves the right to accept or decline representation or any engagement with respect to any client or matter within its sole discretion consistent with its ethical obligations.

Areas Covered by the Service

BC3CBa engages in the following general areas of law, in addition to other legal services not necessarily mentioned here: legal advice and consultations; litigation representation in most courts; data privacy and protection law; counsel on technology and the internet; civil litigation and advice; corporate legal advice; intellectual property protection law; and family law advice. Your matter engagement will be under definitive terms expressed in an engagement letter or other writing which will detail the services to be performed and the fee and other arrangements appropriate for your matter. BC3Cba does not guarantee any case outcome or result on any matter or case from which this description is taken because no lawyer or law firm can do so, rather all outcomes depend on a multitude of factors specific to each circumstance.

Client Responsibilities

To represent you effectively, we must have complete and accurate information in a timely manner related to your case. You have the obligation to provide us with all requested documentation in a prompt manner, provide all available facts that are known to you pertaining to your case; and respond in a timely manner to communications from BC3Cba. Failure to fully cooperate and timely provide information may affect the outcome of your case and could cause our service to be terminated as well.

Engagement Processing; Procedure for Consultation

Engagement is typically scheduled by contacting BC3Cba for an initial consultation. That consultation can be in person, by telephone, or using a secure, web-based platform. A client is invited to provide all pertinent documents and discuss the matter that is of legal concern. With the information provided, BC3Cba will analyze the matter and offer a custom-designed legal solution. An engagement letter which outlines the scope of work, fees, and other terms must be executed before representation can commence. Continuation of either advisory or litigation services will be governed by the terms in the engagement letter.

Payment, Fees and Billing

BC3Cba bills its fees according to the nature and complexity of a legal matter, expertise needed, and estimated efforts required. The fee arrangements may take any form as agreed by the parties in writing including hourly, flat, retainer or any other method. Clients are obliged to pay all bills promptly according to the terms of their engagement letters. All account balances not paid when due are subject to interest charges and unpaid balances may be subject to suspension or termination of services. BC3Cba may revise its fees from time to time and will formally advise clients of any increases to fees that will apply to ongoing matters.

Confidentiality and Confidential Client Data

BC3Cba are firmly committed to protecting the privacy of client information and data and to the confidentiality of related information that we hold in accordance with the law and professional ethical standards. We take the view that all information and documents made available to us by a client is confidential and will not be disclosed to any third party without the express permission of the client, save when required to do so by the law or other regulations. The firm’s sensitive data and information are protected through our use of appropriate security measures and information technology whenever we handle matters involving technology or data protection law. Client(s) retain the right to terminate services at any time upon written notice subject to the terms of the fee agreement. Client(s) remain obligated to pay all fees and costs incurred up to and through the date of termination.

BC3Cba reserves the right to update or revise these Terms of Service at any time in order to comply with legal requirements, advance technological advancements, or address firm policy modifications. Revised terms will be published on this website and will be effective upon publication. We advise all users and clients to review this page on a regular basis in order to remain informed of any rights and obligations which may arise. Continued use of services offered by BC3Cba following a change or modification of terms will be deemed acceptance of the changes.

Applicable Law and Jurisdiction

Terms of Use and Service are governed by California State law and the applicable provisions of federal law. Any dispute resulting from or pertaining to the use of any BC3Cba service or this site shall be adjudicated in a state or federal court of Kern County, California. By entering into a relationship with BC3Cba, you understand and agree to be subject to the exclusive jurisdiction and venue of these courts for all resolution of all legal matters.

Arbitration

In the event a dispute arises between a client and BC3Cba relating to these Terms of Service, each party agrees to first attempt to resolve the dispute in accordance with good-faith negotiations between the parties. If the dispute is not otherwise settled through bargaining and compromise, the parties may agree to submit the dispute to binding arbitration proceedings conducted exclusively in the City of Bakersfield, California, according to the American Arbitration Association’s commercial rules of practice. Nothing in this provision prohibits either party from pursuing injunctive or other equitable relief in a court of law where appropriate.
